1.1 These General Terms and Conditions (GTC) apply to all orders and deliveries of goods via the online shop of:

(hereinafter referred to as “DARKGOLD”).
1.2 For the purposes of these Terms and Conditions, consumers are natural persons who enter into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. Entrepreneurs are natural or legal persons or partnerships with legal capacity who, when entering into a legal transaction, act in the exercise of their commercial or independent professional activity.
1.3 Any differing terms and conditions of the customer shall not apply unless DARKGOLD expressly agrees to them in writing.
2.1 The purchase agreement is concluded with DARKGOLD UG.
2.2 The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
2.3 By clicking the order button, the customer submits a binding offer to purchase. The contract is concluded as soon as DARKGOLD confirms the order by email or ships the goods.
3.1 All prices quoted are final prices in euros and include statutory VAT. Shipping costs are shown separately during the order process.
3.2 The available payment methods are displayed during the order process.
3.3 The purchase price is due immediately upon conclusion of the contract.
4.1 Delivery will be made to the delivery address specified by the customer.
4.2 Delivery times are specified during the ordering process and are non-binding unless expressly agreed otherwise.
4.3 If a product is unavailable, the customer will be informed immediately.
4.4 DARKGOLD reserves the right to make partial deliveries, provided this is reasonable for the customer.
5.1 Alcoholic beverages are sold exclusively to persons over 18 years of age.
5.2 By submitting the order, the customer confirms that they have reached the legal minimum age.
5.3 DARKGOLD reserves the right to request proof of age or to allow the delivery of goods only after age verification by the delivery service.
6.1 Consumers have the right to withdraw from the contract within fourteen days without giving any reason.
6.2 The cancellation period is fourteen days from the day on which the customer received the goods.
6.3 To exercise the right of withdrawal, the customer must inform DARKGOLD of his decision by means of a clear statement (e.g. by email or letter).
6.4 The customer shall bear the return shipping costs unless otherwise agreed.
6.5 There is no right of withdrawal in the case of:
sealed goods whose seal has been removed after delivery
custom-made or personalized products
The goods remain the property of DARKGOLD until full payment is received.
The statutory warranty rights under German law apply.
9.1 DARKGOLD is fully liable in cases of intent and gross negligence.
9.2 In cases of slight negligence, DARKGOLD is only liable for breaches of essential contractual obligations.
9.3 No liability is accepted for damage caused by improper storage or use of the products.
10.1 Alcoholic beverages should be consumed responsibly.
10.2 DARKGOLD accepts no liability for health consequences of excessive consumption.
10.3 Pregnant women, breastfeeding women and people with health conditions are advised against consuming alcohol.
All content of the online shop, including texts, images, designs and trademarks, is the property of DARKGOLD or licensors and may not be used without written consent.
12.1 Personal data will be processed exclusively in accordance with the statutory data protection regulations.
12.2 Further information is contained in the privacy policy on the website.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Leverkusen.
15.1 Sales are primarily within the EU.
15.2 Shipping costs are shown separately during the ordering process.
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory regulations.
